Winter Storage Agreement

The person or persons designated as Lessee as it appears on this contract, who have executed the agreement, acknowledge that they are the legal owner or one of the co-owners and are authorized to enter into this agreement. The Lessor (Oak Hill Marina, Inc., dba Oak Hill Marina) shall not be held liable for any damage or claims arising out of damage to the Lessee's stored equipment sustained as a result of fire, theft, acts of a third party, corrosion, roof collapse, vandalism, or acts of nature. The Lessor is not responsible for loss or damage to canvas or boat covers. Unless prior notification is given, it is assumed that the boat cover/canvas is suitable for transport to the storage location and storage. The Lessee agrees to have the watercraft and trailer covered by full insurance (hull coverage as well as indemnity and liability coverage) naming Oak Hill Marina, Inc. As additional insured. All boat owners must maintain their own insurance coverage to protect against liability, theft, pilferage, vandalism, fire, windstorm, snowstorm, and/or other casualty or loss. It is expressly agreed by the boat owner that Oak Hill Marina, Inc. Is not in any way an insurer of the owner's property. All personal and accessory articles that you wish to remove must be taken from the boat before the winterization process is started. It is a good idea to remove all personal property as Oak Hill Marina, Inc. Is not responsible for property left in the boat. The Lessee acknowledges that their boat will be transported to an offsite winter storage location after it has been serviced and again transported back in the spring. In the case that the Lessor will transport the Lessee's boat on the Lessee's trailer, the Lessee grants that their trailer is in proper functioning condition and is suitable to transport the boat to and from the storage location. If the trailer suffers a mechanical failure during transportation or while in storage, the Lessee acknowledges that the Lessor will need to perform additional service to make the trailer road worthy at additional expense to the Lessee. This would include but not be limited to parts, labor, or towing fees. Oak Hill Marina, Inc. May limit access to the boat storage site at its discretion. Oak Hill Marina, Inc. may also limit activities that may be performed at storage sites. All storage boats must be picked up by August 15th, 2024. Boats left after August 15th, 2024 may be transported offsite and owners will be responsible for all costs including but not limited to transportation, additional storage fees, and penalties. The Lessee agrees to pay for any additional handling of their equipment necessary to accommodate their special requests. In the event of litigation, all attorney fees are the responsibility of the boat owner. The parties hereto have duty executed with this Winter Storage Contract.
